E-Filing

More courts today are requiring electronic submissions, and they each have their own preferences and procedures. At Record Press, nationwide e-filing is what we do. SECOND DEPARTMENT
EXPANDING E-FILING

As of December 3, 2018, the Second Department has expanded e-filing to include the entire Ninth Judicial District. From now on, appeals in all matters originating and electronically filed in Supreme and Surrogate’s Courts in Dutchess, Orange, Putnam, and Rockland Counties will also need to be e-filed.

AD-EF-03B Statement of Authorization for Electronic Filing (Managing Attorney Authorizing Filing Agent) A form authorizing a filing agent to e-file documents on behalf of multiple attorneys within the same firm/agency. (To be e-filed prior to or together with the first e-filing in the matter by the agent)
AD-EF-03C Revocation of Authorization for Electronic Filing – Individual Attorney A form revoking a prior authorization given to a filing agent to e-file documents on behalf of an individual attorney. (Must be sent to the E-Filing Resource Center for processing)
AD-EF-03D Revocation of Authorization for Electronic Filing – Managing Attorney A form revoking a prior authorization given to a filing agent to e-file documents on behalf of a multiple attorneys at the same firm/agency. (Must be sent to the E-Filing Resource Center for processing)
AD-EF-04 Attorney Exemption Certification This form must be served and filed with the Clerk’s office when an attorney seeks an exemption from e-filing pursuant to 22 NYCRR 1245.4(a)[2].
AD-EF-05 Notice of Hard Copy Submission – E-Filed Matter This form must accompany hard copy submissions in e-filed matters as provided in 22 NYCRR 1245.6(e).
AD-EF-06 Notice of Intent to Cease E-Filing This form must be served on all parties and filed with the court when a self-represented litigant withdraws his or her consent to participate in e-filing in a particular matter pursuant to 22 NYCRR 1245.4(e).
For 3rd Department Only Statement of E-Filing A form required for any matter was e-filed in the trial court in which the notice of appeal was filed on or after April 1, 2018.
OR For any matter in which all parties consent to the case being e-filed and where the notice of appeal is filed on or after April 1, 2018

In NY State Courts, e-filing is not synonymous with digital copy submission. E-filing refers to cases filed through NYSCEF. A digital copy submission is a digital version of a record or brief provided to the court in matters not eligible for e-filing.
